At a Glance: Summary of Key Points
Before diving into the details, here is a quick overview of what you are agreeing to when you use Aethr:
- The Service: Aethr is a web-based business management platform designed to help content creators and influencers manage sponsorships, track analytics, generate invoices, and monitor UK Advertising Standards Authority (ASA) compliance.
- Your Obligations: You must provide accurate information, keep your account secure, and use the platform legally. You are solely responsible for the content you upload and your actual compliance with ASA guidelines.
- Payments: We offer a free tier and a paid Pro tier. Paid subscriptions are billed in advance through our payment processor, Stripe.
- Liability: We provide Aethr "as is." While we offer tools to help monitor ASA compliance, we are not a law firm, and our tools do not constitute legal advice. Our liability is limited to the amount you paid us in the past 12 months.
- Disputes: We prefer to resolve issues informally. If we cannot, disputes will be resolved under the laws of England and Wales.
- Termination: You can cancel your account at any time. We can suspend or terminate your account if you violate these terms.
- Contact: You can reach us anytime at contact@useaethr.com.
1. Welcome & Agreement
Welcome to Aethr. We are thrilled to have you on board. Aethr provides a specialized suite of tools to help you manage your brand deals, track your audience, and build your business as a professional content creator.
By creating an account, logging in via email or Google, or otherwise using our platform at useaethr.com, you are agreeing to be bound by these Terms of Service. If you do not agree with these terms, you may not use our services. We want these terms to be as clear and transparent as possible, so you know exactly what to expect from us and what we expect from you.
If you have any questions about this agreement, please reach out to us at contact@useaethr.com before you start using the platform.
2. About Our Service
What Aethr Provides
Aethr is a cloud-based software-as-a-service (SaaS) platform built specifically for the creator economy. We provide tools that allow you to generate professional invoices, track audience analytics across multiple social media platforms, manage a content calendar, and create shareable public media kits for brand partnerships. We also provide features designed to help you monitor your compliance with UK Advertising Standards Authority (ASA) disclosure requirements.
Eligibility
To use Aethr, you must be at least 18 years old and capable of forming a binding contract. Because our platform is designed for business management, invoicing, and brand sponsorships, it is intended for adult professionals. By using Aethr, you represent that you meet these requirements.
Service Availability
We know your business relies on our platform, so we work hard to keep Aethr up and running smoothly. However, because our service is cloud-based and relies on internet infrastructure, we cannot guarantee 100% uptime. We may occasionally need to take the platform offline for maintenance, updates, or to address security vulnerabilities. Whenever possible, we will notify you in advance of any planned downtime.
3. Your Account
Registration and Accuracy
You can create an Aethr account using your email address or by linking your Google account. We require you to provide accurate, current, and complete information during registration. We need this information to ensure your invoices generate correctly, your account remains secure, and we can contact you about important service updates.
Account Security
You are responsible for safeguarding your account credentials. Because Aethr houses sensitive business data—including your financial invoices and brand contracts—we strongly encourage you to utilize our Two-Factor Authentication (2FA) feature. You must notify us immediately if you suspect any unauthorized access to your account.
Account Sharing
Your Aethr account is personal to you or your specific creator business. You may not share your login credentials with third parties. If you have a management team or agency, they must access your information through designated sharing features (like your public media kit) rather than logging into your personal account.
4. Acceptable Use
How You May Use Aethr
We built Aethr to help you grow and manage your creator business. You may use our platform to track your analytics, manage your schedule, communicate with brands, and handle your invoicing in accordance with these terms.
Prohibited Activities
To protect our community and our infrastructure, you agree not to:
- Use Aethr for any illegal, fraudulent, or unauthorized purpose.
- Upload content that contains malware, viruses, or malicious code.
- Attempt to reverse engineer, decompile, or hack the Aethr platform.
- Scrape, crawl, or use automated bots to extract data from our website.
- Use our ASA compliance tools to intentionally obscure, manipulate, or bypass legal advertising disclosures.
- Interfere with or disrupt the integrity or performance of our cloud infrastructure.
Consequences of Violations
If we determine that you have violated these acceptable use rules, we reserve the right to suspend or terminate your account immediately, with or without notice.
5. Content & Intellectual Property
Your Content
You retain full ownership of all the data, media kits, calendar entries, and analytics you upload or connect to Aethr. We do not claim ownership over your intellectual property. By using our service, you grant us a limited, worldwide, non-exclusive license to host, store, and process your content solely for the purpose of operating the Aethr platform. We utilize Amazon Web Services (AWS) to securely host this data.
Our Intellectual Property
Aethr owns the platform, the underlying software, our website design, our logos, and the templates we provide (such as our invoice and media kit layouts). You may not copy, modify, or distribute our intellectual property without our written permission. We grant you a limited, revocable, non-transferable license to use our software solely as intended through your web browser.
6. Payments & Billing
Subscription Tiers
Aethr operates on a freemium model. We offer a free tier with basic features and a paid Pro tier that unlocks advanced analytics, premium media kits, and enhanced ASA compliance tracking. Pricing for the Pro tier is clearly displayed on our website.
Billing Cycles and Methods
If you upgrade to Aethr Pro, you will be billed in advance on a recurring monthly or annual basis, depending on the plan you select. All payments are processed securely through our third-party payment provider, Stripe. We do not store your full credit card details on our servers.
Refunds and Cancellations
You may cancel your Pro subscription at any time through your account settings. Cancellation will take effect at the end of your current billing cycle, and you will retain access to Pro features until then.
Under UK law, consumers have a 14-day "cooling-off" period to request a full refund after upgrading to a paid digital service. If you request a refund within 14 days of your initial Pro upgrade, we will honor it. Outside of this 14-day window, all subscription fees are non-refundable, and we do not provide prorated refunds for partial months.
Price Changes
We may occasionally adjust our pricing as we add new features to the platform. If you are an active Pro subscriber, we will notify you by email at least 30 days before any price increase takes effect, giving you ample time to cancel if you choose not to accept the new rate.
7. Privacy
Protecting your data is a core priority for us. Because we operate out of the UK and serve a global user base, we process your personal data in strict accordance with the UK GDPR, the EU GDPR, and the Data Protection Act 2018. We also maintain SOC 2 compliance standards to ensure your information is handled securely.
We retain your data only until you delete your account. For complete details on how we collect, use, and protect your information—including your rights to access, correct, or delete your data—please review our comprehensive Privacy Policy.
8. Disclaimers & Limitations
Service "As Is"
We provide Aethr on an "as is" and "as available" basis. While we strive to build a flawless product, we do not warrant that the platform will be entirely free of bugs, errors, or interruptions.
Not Legal Advice
Aethr includes features designed to help you monitor compliance with the UK Advertising Standards Authority (ASA). These features are organizational tools, not legal advice. We do not guarantee that using our tools will make you legally compliant with ASA regulations or any other advertising laws. You are solely responsible for ensuring your social media posts and brand deals comply with all applicable laws and regulations.
Limitation of Liability
To the maximum extent permitted by law, Aethr shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the platform. In no event shall our total liability to you exceed the amount you paid to Aethr in the twelve (12) months preceding the event giving rise to the claim.
Consumer Exceptions
If you are using Aethr as a consumer under the UK Consumer Rights Act 2015, nothing in these terms will limit your statutory rights regarding digital content that is faulty or not as described.
9. Dispute Resolution
Informal Resolution
If you have an issue with Aethr, we want to fix it. Before filing any formal legal claim, you agree to try resolving the dispute informally by contacting us at contact@useaethr.com. We will work with you in good faith to find a fair solution.
Governing Law and Jurisdiction
If we cannot resolve the dispute informally within 30 days, any subsequent legal action must be resolved in the courts of England and Wales. These Terms of Service are governed by and construed in accordance with the laws of the United Kingdom (specifically England and Wales), without regard to its conflict of law principles.
10. Changes & Termination
Modifying These Terms
The digital landscape moves fast, and we may need to update these terms to reflect new features, legal requirements, or business practices. If we make material changes, we will notify you via the email address associated with your account or through a prominent notice on the platform. Your continued use of Aethr after the effective date of the updated terms constitutes your acceptance of the changes.
Termination by You
You can terminate this agreement at any time by deleting your account in your account settings. Upon deletion, your data will be permanently removed from our active systems in accordance with our Privacy Policy.
Termination by Us
We reserve the right to suspend or terminate your access to Aethr at any time if you breach these Terms of Service, engage in illegal activities, or if we are required to do so by law.
